RIGHT OF WITHDRAWAL

How to Exercise the Right of Withdrawal

If you are purchasing as a consumer, you have the right to withdraw from your purchase within fourteen (14) calendar days from the date you receive your order.

To exercise your right of withdrawal, you must notify us by email at contacto@x-emoto.com.

The product must be returned within fourteen (14) days after our return authorization has been confirmed.

X-Emoto will refund the purchase price of the product using the same payment method used for the original transaction.

The direct cost of returning the product shall be borne by the customer.

In accordance with current e-commerce regulations, consumers are granted a period of fourteen (14) calendar days to exercise their right of withdrawal.

Important Notice

Returned products must be complete, unused, and in perfect condition.

Products that are incomplete, damaged, worn, dirty, or otherwise altered will not be accepted.

Electric motorcycles may not be used prior to return, as their value is significantly reduced through wear to components such as the battery, tires, suspension, and other parts.

Returns will not be accepted for motorcycles that have been derestricted, modified, or customized.

For hygiene reasons, certain products may not be eligible for return.

If the order was financed through a credit agreement, any financing-related costs or fees shall be borne by the customer.

Restrictions on the Right of Withdrawal

The right of withdrawal does not apply to:

  • Consumables and spare parts once their sealed packaging has been opened.
  • Products manufactured or supplied to order (including, but not limited to, batteries and custom-adapted brake systems).
  • Special orders, including items not listed in the standard catalog or specifically requested by the customer.

Orders for made-to-order or special-order products cannot be modified or cancelled once confirmed.

Orders placed by business customers may not be cancelled without the prior written agreement of X-Emoto.

If a business customer unilaterally cancels an order, X-Emoto reserves the right to charge a cancellation fee of at least twenty-five percent (25%) of the total order amount, including VAT.

WARRANTY AND LIABILITY

Products are manufactured and tested according to the highest quality standards.

Our warranty covers:

  • Defects in materials.
  • Manufacturing defects.
  • Assembly defects.

Warranty Ownership

The warranty applies only to the original purchaser and is non-transferable.

Warranty Exclusions

The warranty does not apply to:

  • Rental vehicles.
  • Motorcycles used for commercial purposes.
  • Motorcycles used in racing or competition.

Warranty Limitations

The warranty does not cover damage caused by:

  • Failure to follow the user manual.
  • Modifications to the original design.
  • Accidents.
  • Misuse or abuse.
  • Negligence.
  • Water damage.
  • Improper storage.

Consumable Components

Consumable components are considered to have a manufacturing defect only if they fail within six (6) months from the date of purchase.

After this period, any defect is presumed to be the result of normal use unless the customer can prove otherwise.

Racing and Extreme Use

Any warranty coverage for damage resulting from racing, competition, or extreme use is expressly excluded.

Transport Costs

Warranty coverage does not include shipping or transportation costs associated with returning motorcycles or individual components.

Repair, Replacement, or Refund

Any decision regarding repair, replacement, or refund is subject to the evaluation and approval of the manufacturer or authorized distributor.

Limitation of Liability

X-Emoto shall not be liable for any damages arising from the use of its products, including but not limited to:

  • Personal injury.
  • Property damage.
  • Economic loss.

Components Subject to Normal Wear and Tear

The following components are considered wear items and are not covered for normal deterioration:

  • Battery
  • Brake pads
  • Tires
  • Chain and lubricants
  • Suspension components
  • Seat
  • Lights
  • Cables and connectors
